Terms of Service

1. Acceptance of terms
These Terms of Service (“Terms”) govern your access to and use of the PodMonitor website and services (the “Service”). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. The Service
PodMonitor provides analytics, rankings, and research about podcasts built from publicly available data. We may add, change, or remove features at any time, and we may limit or discontinue the Service in whole or in part.
3. Accounts
Some features require an account. You are responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate information and to notify us of any unauthorized use. You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to create an account.
4. Subscriptions and billing
- Paid plans are billed in advance on a recurring basis (for example, monthly or annually) through our payment processor, Stripe.
- Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
- You can cancel at any time; cancellation takes effect at the end of the current billing period, and you retain access until then.
- Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods.
- We may change prices or plan features. We will give reasonable notice of price changes, which take effect at your next renewal.
5. Acceptable use
You agree not to:
- Scrape, crawl, or bulk-download the Service or use it to build a competing dataset or product, except through any interface we explicitly provide for that purpose.
- Access the Service through automated means or attempt to circumvent rate limits, access controls, or paywalls.
- Reverse engineer, interfere with, or disrupt the Service or its infrastructure.
- Resell, sublicense, or redistribute data from the Service without our written permission.
- Use the Service for any unlawful purpose or in violation of these Terms.
6. Data accuracy
PodMonitor is built from public, third-party data (such as public YouTube statistics) that we capture at points in time. We do our best to present it faithfully, but we do not guarantee that any figure, ranking, or insight is accurate, complete, or current. See our Methodology for how the numbers are produced. The Service is provided for informational purposes and is not professional, financial, or business advice.
7. Intellectual property
The Service, including its design, text, and original compilations of data, is owned by PodMonitor and protected by applicable laws. Underlying public data remains the property of its respective owners. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal purposes.
8. Third-party services
The Service integrates with third parties such as Stripe, Supabase, and Microsoft Clarity, and may link to third-party sites. We are not responsible for third-party services or content, and your use of them is subject to their own terms and policies.
9. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination — including ownership, disclaimers, and limitations of liability — will survive.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
11. Limitation of liability
To the maximum extent permitted by law, PodMonitor and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or fifty US dollars.
12. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
